The Last Leg of the Term

The end of oral arguments for this Supreme Court Term is around the corner.  With 21 cases left (not counting joined dockets in the same case) I compiled some stats on what is still to come.  This post looks at the attorneys, firms, and parties in these 21 cases.  There are two sections of this post.  The first examines the repeat players. This part looks at the lawyers and firms that are counsel to more than one party (merits or amicus) before the end of the term.

In terms of attorneys there are several that represent at least two clients in the Supreme Court before the term’s end (per the Supreme Court’s dockets).  The figure below shows all attorneys that represent at least two clients before then end of the term.

Several attorneys are counsel on three briefs.  West Virginia Solicitor General Elbert Lin is on three amicus briefs during this period. Herbert Titus from William J. Olson, PC, Neal Kaytal from Hogan Lovells, and Paul Clement from Bancroft PLLC are also counsel of three briefs apiece.

Next there are a handful of law firms of record for at least two clients before the end of the term as you can see in the figure below.

Several of these firms are counsel for at least four clients prior to the end of the term.  Both Mayer Brown and WilmerHale represent four clients.  Jenner & Block and Gibson, Dunn & Crutcher both have five remaining clients.  The two firms with significantly heavier Supreme Court client loads prior to the end of the Term are Hogan Lovells and Jones Day.  Jones Day has a mix of merits and amicus representation that add up to ten total clients (I discuss Jones Day’s success on during the previous term in another post).  Hogan Lovells represents seven amicus curiae in the twenty cases left in this Supreme Court Term. At the end of the post I list all attorneys and law firms that represent one client prior to the end of the Term.

The second section elaborates on all of the cases remaining in the term.  It begins with each case name and the issue area of the case.  Then it goes through the merits parties, attorneys and firms, followed by the amici and respective attorneys and firms.

Interestingly but perhaps not surprisingly, the range of amicus curiae filings in these cases is large.  At the high end there are 70 amicus filings in the Burwell cases, 26 in Escobar, 24 in U.S. v. Texas, and 23 in Cuozzo.  At the other end of the spectrum there were no amicus briefs filed in Dietz v. Bouldin.  Below is information about each case still remaining.
